This cause comes before the Court on the motion of the defendants, Anne Johnston and Arthur Johnston, for judgment notwithstanding the verdict or, alternatively, for new trial. This is a subrogation action brought by the insurer of a yacht against the insured’s charter agent, alleging negligence and breach of an oral agency contract in the procurement of the yacht’s last known charterer. The yacht (the Pegasus) never returned from that charter and is presumed stolen.…
