MEMORANDUM OF OPINION

A trial was held in the instant adversary action on January 10 and 11, .1983. The Complaint was brought by the trustee to recover on an insurance policy for the loss *340of a piece of machinery, a coal auger. The parties have consented to this Court entering a final judgment and have agreed that no evidence would be submitted to any other court should the matter be appealed.
