This matter comes on before the court on the application of the People, by notice of motion filed August 26, 1998, for an order pursuant to CPL 250.10 (3) directing defendant to submit to an examination by a psychiatrist designated by the District Attorney. In the alternative, the People seek an order precluding defendant from offering evidence of his intoxication on the date in question, or evidence relating to the defense of extreme emotional disturbance, due to his failure to file notice of his intent to offer psychiatric evidence under CPL 250.10…
