DOHERTY, District Judge.
Pending before the Court is a Motion to Dismiss [Doc. 2] under Fed.R.Civ.P. 12(b)(6) filed by the defendants, C.B. Fleet Holding Co. and C.B. Fleet Company, Inc. (collectively, “Fleet”). Fleet seeks dismissal of Counts II (Enrichment without Cause pursuant to La. C.C. Art. 2298), III (Violation of Louisiana Unfair Trade Practices Act (LUTPA) pursuant to La.
