The main issue presented is whether the common law requirement for demand of rent can be abrogated by the agreement of the parties.

The defendant-appellant, Mr. Transmission, Inc.,1 entered into a lease agreement with C. O. Hitchcock in 1972 to the improved property in question located in Davidson County, Tennessee, for a term of ten years.
