Plaintiff is the register of deeds of Pine county. His elective term expires in January 1947. His is a fee office. In 1942 his income from that source was, in round numbers, $5,000, out of which he paid $2,408.62 for clerk hire.

The individual defendants are the members of the board of county commissioners of that county. In April 1943, acting as such board, they adopted a resolution placing plaintiff’s office upon an annual salary basis of $2,500, with an additional allowance of $800 for clerk hire.
