This was an action of assumpsit, commenced at the May term, 1843, of the circuit court of Claiborne county, by the Commercial Bank of Natchez, against a portion of the present plaintiffs in error and others, as to whom the suit was discontinued.

At the April term., 1847, the defendant in error appeared in *198court, suggested a dissolution of the corporation, by virtue of a judgment of forfeiture by the circuit court of Adams county, at the May term, 1845, thereof, made known his appointment as trustee by the said court, on pronouncing judgment of forfeiture, and moved to revive the suit in his…
