MEMORANDUM AND ORDER

SAND, District Judge.

James Patterson (“Patterson”) petitions this Court pro se for a writ of habeas corpus, pursuant to 28 U.S.C. § 2254. Patterson was convicted after a jury trial in the New York State Supreme Court, New York County, for the criminal sale of a controlled substance in the third degree in violation of New York Penal Law § 220.39. The court sentenced Patterson to a term of imprisonment of five to ten years. On July 2, 1998, the Appellate Division, First Department, unanimously affirmed the conviction. See People v.
