MEMORANDUM OPINION AND ORDER

CAPELLE, United States Magistrate Judge.

The Court held a hearing on October 19, 1993, in the above styled and numbered case on the Plaintiff Bob Hamric Chevrolet, Inc.’s Motion for Summary Judgment filed on August 30, 1993 (# 24) (hereinafter “Hamric”) and on the United States of America’s Motion to Dismiss or for Summary Judgment filed on August 30, 1993 (# 22) (hereinafter “United States”).
