This is an action for damages arising out of an automobile collision which occurred on a paved highway about two miles west of Wasco.

On the evening of February 6, 1944, the two plaintiffs had been at a party at a house two and one-half miles west of Wasco. There was some drinking there although the plaintiffs denied having participated therein. Some sort of a fight developed, so at about 2:30 or 3 o’clock on the morning of February 7, the plaintiffs started to return to Wasco.
