BRYAN, Circuit Judge.

This is an indictment in three counts against W. T. Hilt, and several other defendants. Tbe first count charges a conspiracy to possess with intent to transport without a permit 518 packages of intoxicating liquor. Tbe overt act alleged, to carry into effect tbe object of tbe conspiracy, is that tbe defendants navigated tbe yacht Sarabmac from a place unknown to-a point near Indian Pass, in tbe Southern district of Florida. Tbe second count charges tbe unlawful possession, and tbe third count tbe unlawful transportation, without a permit, of the intoxicating liquor…
