As will be seen from the statement of facts, this case has had a somewhat complicated procedural history. It may be well at the outset to bear in mind that *467there is no appeal here from the interlocutory judgment and no bill of exceptions. Hence, we are not concerned with the questions, (1) whether the findings support a judgment for profits made by defendants through the use of labels simulating those of plaintiff, or (2), whether the findings are supported by the evidence.
