*96MEMORANDUM OPINION
The court is required to decide a novel and previously unresolved question: When a governor pardons a person for a criminal assault conviction, can the fact of the assault be used against that person in a civil action for damages for that assault?
The matter is before the court on the plaintiff’s motion for partial summary judgment, Fed. R. Civ. P. 56, seeking a determination that the defendant’s criminal conviction for assault of the plaintiff collaterally estops the defendant from relitigating the fact of the assault.
