This matter is before the Court on- a motion for judgment upon the agency record brought by Plaintiff Globe Metallurgical Inc. (“Globe” or “Plaintiff’) pursuant to USCIT Rule 56.2.
Plaintiff challenges the U.S. International Trade Commission’s (“ITC” or “Commission”) second sunset review determination concerning the antidumping duty order on silicon metal from Brazil. See Silicon Metal From Brazil and China, 71 Fed.Reg. 71,554 (December 11, 2006). Globe argues that the ITC’s determination is unsupported by substantial evidence and otherwise contrary to law. Pl.’s…
