*546In an action to recover damages for personal injuries, the defendant third-party plaintiff appeals from an order of the Supreme Court, Rungs County (Johnson, J.), dated July 12, 2005, which denied its motion for summary judgment dismissing the complaint and granted the cross motion of the third-party defendant for summary judgment dismissing the third-party complaint.
