This was a scire facias sur municipal lien for paving. The parties, by an agreement in writing filed of record, dispensed with a trial by jury, and the case was tried by the court below, in accordance with the provisions of the act of April 22, 1874. The plaintiff proved that the defendant and others, being a majority in number of the owners of property abutting on the part of the street to be paved, had presented a petition to the councils of the city of Willianisport, praying: “That West Third street, between West and Park streets, should be paved with Trinidad…
