— Proceeding pursuant to CPLR article 78 (initiated in this court pursuant to CPLR 506, subd [b], par 1) to prohibit enforcement of an order of respondent Scheinman, entered January 31,1983, requiring petitioner to remit $2,000 paid to him in *843attorney’s fees.
