This matter is before the Court on Plaintiffs memorandum in opposition to Defendant’s notice of removal (doe. 4). Defendant did not reply.

Plaintiff, The Provident Bank, filed this action in the Court of Common Pleas in Hamilton County, Ohio, on May 13, 1996. Defendant, Franklin Bernard Beck, filed a notice of removal on May 17, 1996, pursuant to 28 U.S.C. § 1441, on the basis of diversity jurisdiction.
