— Order and judgment (one paper), Supreme Court, New York County (Beatrice Shainswit, J.) entered June 29, 1990, which, inter alia, granted partial summary judgment to defendant Aetna dismissing so much of plaintiffs’ complaint as seeks to recover damages with respect to merchandise shipped to plaintiffs prior to May 9, 1985, severed the remainder of the action and transferred the same *473action to the Civil Court, unanimously affirmed, without costs or disbursements.
