is the second appeal in this case. The opinion upon the former appeal is reported in 73 Texas, 216. A brief statement of the case will assist, in showing the questions now presented for our determination.

At the general election held in 1884, W. J. Burk was elected treasurer of Galveston County.. Within the time prescribed by law he gave the bond required by article 988 of the Revised Statutes to secure the performance of his duties as such treasurer.
