Plaintiffs Robert and Doris Danaher filed suit to recover damages incurred from defendants’ breach of contract. A default judgment was entered against all defendants on April 18, 1975. On January 4, 1977, defendant Bibo filed a petition for relief from judgment pursuant to section 72 of the Civil Practice Act (Ill. Rev. Stat. 1975, ch. 110, par. 72). The motion was granted the same day and on January 11,1977, defendant Bibo filed a motion to dismiss the complaint pursuant to section 45 of the Civil Practice Act (Ill. Rev.
