Plaintiff brings this appeal following the dismissal in the trial court of his first amended complaint with prejudice.

On September 15, 1965, attorney Leonard Rose, representing defendants Hiyane and Aero Contact Lens Service, Inc., (hereafter ACRO), in the pending case of House of Vision, Inc. v.
