The petition in this case was dismissed on general demurrer, and the plaintiff excepts. The allegations of the petition, in substance, are as follows: Petitioner was a machinist by trade and was employed in that capacity by the defendant company on November 2, 1908, in its shop in the city of Macon. On or about April 3, 1908, when first employed by the defendant, he was assigned to work under the orders and instructions of a foreman, who was in sole charge of the department where the plaintiff was at work.
