Plaintiff Ed Rudy brings this action asserting that Defendants Walter Coke, Inc., (‘Walter Coke”) and Walter Energy, Inc., (“Walter Energy”) terminated his employment to prevent him from using his health benefits for necessary surgery and in retaliation for using his leave under the Family and Medical Leave Act of 1993 (“FMLA”). The defendants have filed a motion for summary judgment as to both claims. (Doc. 19).1 The court conducted oral argument on May 12, 2014.
