MEMORANDUM AND ORDER
VRATIL, District Judge.
This matter comes before the Court on plaintiffs Motion to Remand (Doc. # 49) filed July 25, 1997. Plaintiffs filed this action in the District Court of Sedgwick County, Kansas, and defendant removed it on November 4, 1994, pursuant to 28 U.S.C. § 1332. On January 26, 1996, the district court granted defendant’s motion for summary judgment, finding that the applicable statute of limita tions barred plaintiffs’ claims. The Clerk entered judgment for defendant on January 29,1996, and plaintiffs timely appealed.
