The appellant, Albert Joseph Fleming, sued the appellee, Johnnie B. Fleming, for divorce in the Chancery Court of "Washington County, alleging as grounds for divorce habitual cruel and inhuman treatment and adultery, and also alleging that the defendant at the time of their marriage had a living husband to whom she had been lawfully married and from whom she had never been divorced.
