This matter comes before the court on the plaintiffs motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure and the motion to suppress presented by claimants James Ronson Taylor and Jamel Earleen Taylor (collectively, “claimants”). This matter was referred to the Honorable Charles K. McCotter, Jr., United States Magistrate Judge, who entered a Memorandum and Recommendation to the court on March 2, 1995.
