Injunction bill.—The bill seeks to enjoin the prosecution of a suit by George W. Willen as assignee of Virginia 0. Truitt and George T. Truitt, of an action to enforce complainant’s liability on a recognizance. The facts are stated in the opinion.

Ridgely, Chancellor ad Litem.:—At the September Term, 1855, of the Orphans’ Court for Sussex County, Benjamin Burton, the complainant, accepted parcel ¡No. 5 of the intestate real estate of his mother, Polly Vessels, who had died in the year 1833, and on the 20th day of September, 1855, entered into a recognizance in the said Orphans’ Court with John H. Burton and Peter B. Burton as his sureties conditioned for the payment to the other parties entitled of the sum of $2,430.73, with interest from the said 20th day of September, 1855. Virginia C.
