Introduction

This case is presently before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction. RUSCC 12(b). Plaintiff, Sally Ann Free, was a federal employee from 1980 to 1987. During the course of her employment, Ms. Free received annual performance appraisal ratings from her superiors. Such evaluations could consist of any one of the following ratings: “outstanding,” “superior,” “fully satisfactory,” “minimally satisfactory,” or “unsatisfactory.” Moreover, it could serve as a basis for a monetary payment award, demotion, grade…
