On February 2, 2012, pro se plaintiff Luis Alberto Chiari (“plaintiff’) commenced this action against defendant New York Racing Association (“NYRA”), alleging violations of his rights under the Consolidated Omnibus Budget Reconciliation Act (“COBRA”), 29 U.S.C. § 1161 et seq., the Americans with Disabilities Act (“ADA”), 42 U.S.C. § 12112 et seq., and the Labor Management Relations Act (“LMRA”), 29 U.S.C. § 141 et seq.
