This is an appeal from the judgment of the district court of Carter county in favor of the Exchange National Bank of Ardmore, Okla., and against the plaintiff. The parties will be referred to as they appeared in the trial court. The action was commenced by the plaintiff in the district court of Carter county on April 9, 1927. The cause was 'tried on plaintiff’s third amended petition. It is an action based on tort growing out of the conversion, misappropriation, and embezzlement of funds of Carter county, by its former treasurer, S. F. Haynie, during his term of office.
