This is an action under the federal employers’ liability act (act April 22, 1908, chapter 149, 35 Stat. 65 [U. S. Comp. St. 1916, sections 8657-8665]) to recover for the death of the plaintiff’s intestate caused by the alleged negligence. of the defendant. The negligence ■ charged was the failure of the defendant to use ordinary care to provide a reasonably safe place in which the plaintiff’s intestate was to work.
