HENDERSON, Judge.

Appellant was convicted of violating the local option law; and prosecutes this appeal.

Prosecuting witness, John King, testified substantially that sometime in the fall of 1905, in the town of Comanche, he asked defendant for a quart of whisky; defendant told him he did not have any, but thought he knew where he could get some. This occurred on the southeast corner of the square in the town of Comanche.
