In this action for personal injuries the sole question is whether there was any evidence to warrant the verdict of the jury for the plaintiff.
The defendant, the owner of a newly completed cottage at Salisbury Beach, rented it, furnished, to the plaintiff for *755a period of four weeks beginning July 1, 1938. Among the furnishings was a movable framework containing an upper and a lower berth. Access to the upper berth could be had by means of a movable wooden ladder, also furnished by the defendant.
