HAMILTON, District Judge.

The defendant, CFW Construction Company, Inc. (hereinafter “CFW”), has been indicted for two counts of conspiring to artificially establish bidding prices (i.e., “rig” bids) on two utility construction projects in South Carolina, in violation of the Sherman Act, 15 U.S.C. § 1 (1976). One such violation allegedly occurred during the period March to October, 1978, and the second violation allegedly took place during the period December 1978 to March 1979.
