Defendant, Qwest Communications Corporation (Qwest), moves to dismiss Counts III, IV, V, and VII of plaintiffs First Amended Complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure 1 and to strike plaintiffs second through fifth requests for damages pursuant to Rule 12(f).
