The matters now before the Court arise in each of the above entitled cases and we will embody our views in one opinion applicable to both cases. It will be necessary to briefly recite thé issues in each case.

In case No. 617 the parties below allege that on the 11th day of November, 1941, W. H. Ford died leaving an estate and leaving the plaintiffs and the defendants, Charles C. Ford and E. T. Ford, his only heirs-at-law and next of kin; that on the 16th day of February, 1942, a writing purporting to be the last will and testament of W. H. Ford, dated the 18th day of June,…
