Joseph M. Coldwell, the defendant below, was indicted and convicted in the District Court of Rhode Island, under title 1, § 3, of the act of Congress approved June 15, 1917, c. 30, 40'Stat. 219, known as the Espionage Act (Comp. St. 1918, § 10212c), which is as follows:
