After entering a plea of guilty to the offense of robbery (Ill. Rev. Stat. 1981, eh. 38, par. 18 — 1), defendant, Reginald Wade, was sentenced to 36 months’ probation with 90 days’ time considered served in the Department of Corrections. Eleven months later the trial court vacated his- sentence over defense objection- on the basis that it had not known of his prior conviction for rape which would have made him ineligible for probation. Defendant then withdrew his plea- of guilty and was tried by a jury before the same trial judge who presided over the guilty plea proceeding. He was convicted…
