Defendant, Travis Whitfield, pled guilty to the offense of aggravated possession of a stolen motor vehicle in the circuit court of Cook County and was sentenced to a term of probation. Shortly after sentencing, the State learned that defendant was ineligible for probation because of his criminal record and moved to vacate the plea.
