TANAKA, J.

This litigation involves a standard form Deposit, Receipt, Offer and Acceptance contract (DROA) between plaintiffs PR Pension Fund (Fund) and Alfred Anthony (Anthony) (collectively Plaintiff), as Buyer, and defendant Donald T. Nakada (Nakada or Defendant), as Seller, in a real estate transaction. Defendant appeals the trial court’s judgment ordering specific performance of the DROA in question in favor of Plaintiff. Plaintiff cross-appeals the trial court’s conclusion that Plaintiff breached the DROA by not closing the purchase on the date specified therein…
