The present suit is to rescind the sale of a second-hand or as more refinely expressed in the language of the trade, a used automobile. The plaintiff in consideration of seven hundred dollars, bought an automobile from defendant on October 16, 1923, he used it continuously from that time, making a trip from Baton Rouge to New Orleans in December, 1923, driving it to Trenton, in the northern part of Missouri in June, 1924, and back to Baton Rouge in September following, and he then filed the present suit on December 16, 1924.
