Benson, J.:

A former judgment in this action was reversed. (Betterment Co. v. Reeves, 73 Kan. 107, 84 Pac. 560.) Upon a new trial the plaintiff, John W. Reeves, again recovered, and this proceeding is brought by the company to review the proceedings upon the second trial.

The facts are fully stated in the former opinion. The negligence charged is, in brief, the failure of the company, engaged in furnishing gas, to place a regulator on its lateral line leading from its high-pressure main to the meter in. the factory where the plaintiff was working,…
