J. F. White was indioted in the Campbell circuit court for an offense denounced by section 1189, Kentucky Statutes. He was tried, convicted and sentenced to serve two years in the penitentiary. Several errors are assigned in his motion for a new trial, but on this appeal only two of them are argued: First, that the evidence does not support the verdict; and, second, the offense of which he was convicted is hot denounced by section 1189, Kentucky Statutes, under which he was tried, but, if it is an offense, is exclusively within the purview of…
