This action was instituted on May 28th, 1902, by “The Morris Street Baptist Church,” a body corporate, having its principal place of worship in the city of Charleston, against John U. Dart. The prayer of the plaintiff was that the defendant be perpetually enjoined and restrained “from exercising or attempting to exercise his alleged functions as alleged pastor” of the said church, and from .entering the pulpit thereof or attempting to preach therein.
