NEILL, Associate Justice.
This suit was brought by appellee to recover damages for personal injuries inflicted by the alleged negligence of appellant. The defenses plead were not guilty and contributory negligence. The trial resulted in a judgment in favor of the plaintiff for $4000, which is appealed from.
Conclusions of Fact.—On the 8th day of March, 1908, the defendant owned and maintained, in connection with its railway, a. pumping station at Denison, which was in charge and under entire control of its servant, E. M. Hood, who had authority to forbid and prevent parties from trespassing…
