Brogan, Chief Justice.
This is an action in quo warranto brought in the name of the State of New Jersey on the relation of Messrs. Van Brookhoven, Berenbach and Craw-buck as relators. These individuals formerly held the office of assistant superintendent of weights and measures in the city of Passaic. From the time of their appointment in 1938, until February, 1940, they aver that they performed the duties of such offices. On the latter date Messrs. McNamara, Shaw and Yatsko were appointed in their place and stead and the relators were dismissed without hearing and for no stated cause.
