I. INTRODUCTION

On January 7, 2000, plaintiff Champion Home Builders Co. (“Champion” or “plaintiff’) commenced the instant action against defendants ADT Security Services, Inc., ADT Security Systems, Inc., and ADT Security Systems, Northeast, Inc., (collectively, “ADT” or “defendants”) in Supreme Court for the State of New York, Oneida County, alleging six state law causes of action.
