MEMORANDUM AND ORDER
MAZZONE, District Judge.
This case comes before me on cross appeals from a final order issued by the Bankruptcy Court. 28 U.S.C. § 158; Bankruptcy Rule 8001(a). The procedural history leading up to these appeals is not in dispute. In March, 1989, the Debtor, Medallion Realty Trust (“Debtor”), filed a petition for bankruptcy pursuant to 11 U.S.C. § 301. Shortly thereafter, the First Service Bank for Savings (the “Bank”), one of the Debtor’s most significant creditors, filed a motion seeking to dismiss the petition on the grounds that the Debtor was not eligible for relief…
