This appeal is from a judgment of the district court of Adams county awarding a divorce to the plaintiff and giving her the custody of the infant child of the marriage. The controversy is in fact over the custody of this child.

Plaintiff and defendant were married in 1930. A child was born to them in 1932. This 'action was brought in 1934. Service was made upon the defendant by mail. He admitted service in writing, stipulated that the case might be heard without further notice to him, and that the custody of the child of the marriage should be divided equally between the parties.
